1. Introduction and Agreement
These Terms and Conditions (“Terms”) apply to your use of FamilySafe, a secure UK digital vault and family organisation service operated by FamilySafe Ltd.
By creating an account, purchasing a plan, accessing the service, or using any FamilySafe feature, you agree to these Terms. If you do not agree, you must not use FamilySafe.
These Terms are intended for the FamilySafe consumer service. Separate or additional terms may apply to partner programmes, organisation accounts, white-label services, business portals or other specialist FamilySafe-operated services.
Our Privacy Policy and Cookie Policy explain how personal data and cookies are handled. They should be read alongside these Terms.
2. Who We Are
FamilySafe is operated by:
- FamilySafe Ltd
- Company number: 16675534
- Registered office: Sisters of St. Joseph, Workhouse Lane, Greetland, Halifax, England, HX4 8BS
- Website: https://familysafe.co.uk
- General support: support@familysafe.co.uk
- Privacy: privacy@familysafe.co.uk
- Security: security@familysafe.co.uk
In these Terms, “FamilySafe”, “we”, “our” and “us” mean FamilySafe Ltd. “You” and “your” mean the person using the service.
3. What FamilySafe Provides
FamilySafe provides tools to help individuals and families organise, store, manage and share important life information in a structured digital vault.
Depending on your plan and the features currently available, FamilySafe may allow you to:
- create structured cards and records across household, financial, legal, personal, property, vehicle and other categories;
- attach documents, files, photographs and supporting material to records;
- store sensitive information using FamilySafe’s encryption and security architecture;
- set reminders, renewal dates, deadlines and other life-admin actions;
- share selected information with trusted family members, advisers and authorised contacts;
- nominate and manage executors and organise information relevant to probate and estate administration;
- upload documents for processing and create draft structured information for your review;
- use the FamilySafe AI assistant for help with the service and with deciding what information may be useful to store;
- generate exports, reports or other copies of information held in your vault;
- use authentication and account-protection features including multi-factor authentication, passkeys, authenticator apps, email verification and recovery codes where available.
FamilySafe is an information organisation and storage service. It does not provide legal, financial, tax, medical, estate-planning, probate or other regulated professional advice.
Storing a document, instruction, wish, nomination or note in FamilySafe does not by itself create, amend, replace or validate a legal document or legal appointment.
4. Eligibility and Account Registration
You must be at least 16 years old to create or hold a FamilySafe account.
You must provide accurate information when registering and keep your account details reasonably up to date.
You may store information relating to family members or other people where you are entitled to do so, but you remain responsible for ensuring that information is held and shared lawfully.
An account is personal to the account holder unless FamilySafe expressly provides a family, organisation or other shared-account arrangement.
5. Plans, Features and Usage Limits
FamilySafe may offer free, premium, family, probate, promotional or other plans. The features, limits, storage allowances, document-processing allowances, number of users and other entitlements available to you depend on the plan shown when you sign up or purchase.
We may add, improve, replace or retire features over time. If we make a material change to a paid plan that significantly affects the service you have purchased, we will provide reasonable notice where required.
Where a Probate or other one-off plan is offered, the scope of that plan will be described at the point of purchase. Any such plan remains subject to these Terms, applicable law and the continued operation of the relevant service.
6. Preview, Beta and Demonstration Services
From time to time we may provide preview, beta, demonstration, test or early-access versions of FamilySafe or individual features.
Unless we expressly state otherwise:
- preview and beta features are provided for testing, evaluation, training or feedback;
- they may be incomplete, unstable, unavailable or changed without notice;
- data entered into a demonstration or test environment may not be retained;
- you should not rely on a preview or demonstration environment as the only place to store critical, permanent or legally required information.
Where a preview environment uses the normal FamilySafe security architecture, the applicable encryption and privacy controls will still apply, but preview status does not guarantee production-level availability or permanence.
7. Your Responsibilities and Acceptable Use
You are responsible for:
- keeping your login credentials, passkeys, authentication methods and recovery information secure;
- activity carried out through your account, except where caused by FamilySafe’s breach or security failure;
- checking that information you save is accurate, current and appropriate for your purposes;
- keeping original or independent copies of documents where an original is legally required or would be difficult to replace;
- choosing carefully who you invite or share information with.
You must not:
- use FamilySafe for unlawful, fraudulent, abusive or harmful purposes;
- upload content that you do not have the right to store or share;
- attempt to access another person’s account, vault or information without authority;
- attempt to bypass, disable, probe or defeat FamilySafe security controls;
- introduce malware, malicious code or material intended to damage or disrupt the service;
- scrape, automate or extract information from FamilySafe in an unauthorised way;
- reverse engineer the service except where the law expressly permits it;
- use FamilySafe to infringe another person’s intellectual property, privacy or other legal rights.
8. Your Information and Ownership
You retain ownership of the information, documents, images and other content that you add to FamilySafe.
You give FamilySafe only the limited rights needed to host, transmit, back up, process and otherwise provide the service to you, subject to our Privacy Policy, security architecture and your sharing choices.
FamilySafe does not acquire ownership of your vault content merely because it is stored using the service.
9. Security, Encryption and Account Recovery
FamilySafe is designed around strong security controls and zero-knowledge principles for protected vault content. Sensitive content is encrypted so that FamilySafe cannot ordinarily read or decrypt the protected content held in your vault.
Certain account, operational and service metadata must remain available to FamilySafe so that we can operate the service, manage accounts, deliver reminders, provide support, process billing, prevent abuse and maintain security. The Privacy Policy explains this in more detail.
Because of the way zero-knowledge encryption works, there may be circumstances in which FamilySafe cannot restore or decrypt protected vault information if you lose the credentials, keys, recovery codes or recovery mechanisms required to access it.
You should keep your recovery information secure and make use of the account-protection features available to you.
No online system can be guaranteed to be completely free from risk. FamilySafe will take reasonable technical and organisational measures to protect the service, but we do not promise that unauthorised access, interruption or security incidents can never occur.
10. Documents and Original Records
FamilySafe allows you to store digital copies of documents and supporting files. A copy stored in FamilySafe may not replace an original document where the original has legal, evidential or practical importance.
You should retain original wills, deeds, certificates, identification documents and other original records where appropriate.
FamilySafe is not an official registry and does not verify the legal validity, authenticity, ownership or current status of documents you upload.
11. Sharing, Family and Adviser Access
FamilySafe may allow you to share selected records, fields or other information with trusted family members, advisers or authorised contacts.
You are responsible for deciding who to invite and what information to share. You should only grant access to people you trust.
A recipient may be able to read, copy, record, download or otherwise retain information that you have shared with them. Removing or revoking access within FamilySafe cannot necessarily remove copies or knowledge already obtained by the recipient.
FamilySafe is not responsible for how an authorised recipient uses information after you have deliberately shared it with them, except to the extent that FamilySafe itself has failed to meet a legal obligation.
12. Probate and Executor Access
FamilySafe includes features intended to help users organise information that may later be relevant to executors and estate administration.
Certain card types or records may be designated by FamilySafe as probate-accessible as part of the product design. This classification may be built into the relevant card type and may not be something that the user can change.
Where the executor-access process is activated and the required FamilySafe verification or release conditions are satisfied, a nominated executor may be given access to information contained in records that are designated as probate-accessible, in accordance with the process and permissions in force at that time.
Naming someone as an executor or trusted person within FamilySafe does not appoint that person as an executor in law, prove that they are entitled to administer an estate, replace a will, or replace any grant of probate, letters of administration or other legal authority that may be required.
FamilySafe provides an organisational and technical access mechanism. It does not decide inheritance rights, ownership disputes, the validity of a will or the legal entitlement of any person to an estate.
13. Reminders, Notifications and User Actions
Where available, FamilySafe may provide reminders, renewal notices, action prompts and notifications by email, in-app notification or another supported channel.
You may be able to snooze, dismiss or manage notification frequency through your account settings.
Reminders are provided as an organisational aid. Delivery can be affected by email providers, device settings, network availability, notification preferences and other factors outside FamilySafe’s control.
You remain responsible for legal, financial, contractual, medical or other deadlines and should not rely on FamilySafe as your only reminder system.
14. Document Processing and Draft Extraction
FamilySafe may allow you to submit documents for automated processing so that information can be extracted and used to create a draft record.
Document processing is intended to reduce manual data entry. Extracted information is not guaranteed to be complete, accurate or correctly classified.
You must review and confirm draft information before relying on it or saving it as your final vault record.
Processing limits, supported file types, file sizes, page limits and monthly or annual allowances may vary by plan and may change over time.
Where FamilySafe retains an original uploaded source file as part of the document workflow, that file remains subject to the same account, retention and deletion rules that apply to your other FamilySafe content.
15. FamilySafe AI Assistant
FamilySafe may provide an AI-powered assistant to help you understand the service, navigate features, decide what types of information you may wish to organise, and receive general guidance about using FamilySafe.
AI-generated responses can be incomplete, inaccurate or unsuitable for your particular circumstances. You should use your own judgement and verify important information.
The FamilySafe AI assistant does not provide legal, financial, tax, medical, probate, estate-planning or other regulated professional advice.
You should consult an appropriately qualified professional where advice is required, particularly where a decision may affect your legal rights, finances, health, estate or another person.
Where an AI feature requires access to information from your vault, that access will operate through the user-authorised flows and security controls provided by FamilySafe.
16. Exports and Reports
FamilySafe may allow you to export some or all of your information in formats such as reports, structured data files or document packages.
Exports are generated from the information available in your FamilySafe account. Their completeness and accuracy therefore depend on the information you have entered, uploaded and maintained.
Unless we expressly state otherwise, a FamilySafe export is not an official probate form, legal inventory, financial statement, tax return or other professionally certified document.
17. Subscriptions, Payments and Billing
The current price, billing frequency, included features and any applicable plan limits will be shown before you purchase a paid plan.
Where you purchase a recurring subscription, it will renew for the billing period shown at purchase until you cancel it, unless we tell you otherwise.
Payments may be processed through third-party payment providers such as Stripe or GoCardless. You authorise the relevant payment to be collected using the payment method you provide.
If a payment fails, is reversed or remains unpaid, we may retry collection, ask you to update your payment method, restrict paid features, place the account into a lower-plan or read-only state, or suspend the paid service where reasonable.
If we change the price of an existing recurring subscription, we will provide reasonable advance notice before the new price applies to a future renewal. You may cancel before the new price takes effect.
Nothing in these Terms removes any statutory right you may have to cancel a contract, receive a refund or obtain another remedy under UK consumer law. Where a statutory cancellation period applies, FamilySafe will honour it.
Unless required by law or stated otherwise at purchase, cancelling a subscription normally stops future renewals rather than creating an automatic refund for a billing period that has already begun.
18. Cancelling a Subscription, Closing an Account and Deleting Data
Cancelling a paid subscription, closing your FamilySafe account and requesting deletion of your data are different actions.
- Subscription cancellation: stops future paid renewals. Paid access will normally continue until the end of the current paid period unless the product states otherwise.
- Plan downgrade or read-only access: after a paid plan ends, some functionality may be restricted, removed or placed into read-only mode depending on the plan rules then in force.
- Account closure: closes your FamilySafe account and may make your vault unavailable to you.
- Data deletion: permanently removes data and associated cryptographic material where applicable, subject to information that FamilySafe is legally required or permitted to retain.
Deletion of cryptographic material may make encrypted content permanently unrecoverable. Where possible, you should export any information you wish to keep before requesting deletion.
Further information about retention and deletion is provided in the FamilySafe Privacy Policy.
19. Service Availability, Maintenance and Changes
We aim to provide a reliable service, but FamilySafe is not guaranteed to be continuously available or free from errors.
We may carry out maintenance, security work, upgrades or emergency changes that temporarily affect access.
We may change the service to improve security, usability, legal compliance or functionality. We will try to avoid materially reducing the core value of a paid service without reasonable notice.
If FamilySafe permanently withdraws a paid service, we will provide reasonable notice where practicable, provide an opportunity to export information where reasonably possible, and honour any refund or other remedy required by law.
20. Privacy and Data Protection
FamilySafe processes personal data in accordance with its Privacy Policy and applicable UK data protection law, including the UK GDPR and Data Protection Act 2018.
The Privacy Policy explains what account information and operational metadata FamilySafe can access, what content remains encrypted, how data is used, which service providers are involved, retention arrangements and your data-protection rights.
If you choose to share information with another user or authorised contact, that person may become independently responsible for how they use information they receive.
21. FamilySafe Intellectual Property
The FamilySafe service, software, platform design, card templates, branding, logos, text, graphics and other FamilySafe-created materials are owned by or licensed to FamilySafe Ltd.
These Terms give you a personal, limited, non-exclusive right to use the service for its intended purpose. They do not transfer ownership of FamilySafe intellectual property to you.
You must not copy, resell, commercially exploit or distribute the FamilySafe platform or source code without permission.
22. Consumer Rights and Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, and nothing affects your statutory rights as a consumer.
FamilySafe will provide the service with reasonable care and skill. We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when you entered into these Terms.
FamilySafe is provided for personal and family organisation. If you use the consumer service for commercial or business purposes, we are not responsible for business losses such as loss of profit, revenue, business opportunity or goodwill, except where the law does not allow such liability to be excluded.
We are not responsible for professional decisions made by you or another person based solely on information stored in FamilySafe, an automated extraction, a reminder, an export or an AI-generated response.
We are not responsible for misuse by a recipient after you have deliberately authorised that recipient to access information, although this does not limit our responsibility for our own security, data-protection or contractual obligations.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be limited.
23. Suspension or Termination by FamilySafe
We may suspend, restrict or terminate access where reasonably necessary, including where:
- you materially breach these Terms;
- your use of the service is unlawful, fraudulent, abusive or harmful;
- your account creates a security risk to FamilySafe, another user or a third party;
- we reasonably suspect unauthorised account access or misuse;
- a required payment remains unpaid;
- we are required to act by law, court order, regulator or other lawful authority.
Where reasonably possible, we will explain the reason and give you an opportunity to correct the issue before permanent termination, except where immediate action is necessary for security, legal or abuse-prevention reasons.
24. Changes to These Terms
We may update these Terms where reasonably necessary to reflect changes to FamilySafe, our business, security requirements, legal obligations or regulatory requirements.
If a change materially affects your rights or obligations, we will provide reasonable notice by email, in-app notification, website notice or another appropriate method.
The updated Terms will state their effective date. If you do not wish to accept a material change, you may stop using FamilySafe and cancel any affected recurring subscription before the change takes effect, subject to your statutory rights.
25. Third-Party Services
FamilySafe may rely on third-party providers for services such as payments, hosting, storage, email delivery, security, support and document processing.
Some third-party services or links may be governed by their own terms and privacy policies. FamilySafe is not responsible for independent third-party services that you choose to use, but this does not reduce FamilySafe’s responsibility for its own obligations under these Terms or applicable law.
26. General Contract Terms
If any part of these Terms is found to be invalid or unenforceable, the remaining parts will continue to apply.
If we delay enforcing a right under these Terms, that does not mean we have waived that right.
You may not transfer your account or your rights under these Terms to another person without our consent, except where the law gives you a right to do so.
FamilySafe may transfer its rights and obligations as part of a company sale, merger, investment, group reorganisation or transfer of the service, provided that doing so does not reduce your statutory rights.
27. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you retain any mandatory protections available to you under the law of the part of the UK where you live and may be entitled to bring proceedings in your local courts.
28. Complaints and Contact
If you have a question, complaint or concern about FamilySafe, please contact:
- General support: support@familysafe.co.uk
- Privacy matters: privacy@familysafe.co.uk
- Security matters: security@familysafe.co.uk
- Postal address: FamilySafe Ltd, Sisters of St. Joseph, Workhouse Lane, Greetland, Halifax, England, HX4 8BS
We will try to resolve complaints fairly and within a reasonable time. Nothing in this section limits any right you have to contact a regulator, ombudsman, court or other body where applicable.
29. Plain-English Summary
In summary:
- FamilySafe helps you organise and protect important family information; it is not professional legal, financial, tax, medical or probate advice.
- You own your vault content and control who you share it with.
- Protected vault content is designed around zero-knowledge encryption, which also means recovery may be impossible if the required access and recovery information is lost.
- Document extraction and AI assistance can make mistakes, so important information should be checked by you.
- Executor access applies through FamilySafe’s probate-access rules and does not itself create legal executor status.
- Reminders are helpful prompts, not a substitute for managing important deadlines.
- Paid subscriptions renew until cancelled, subject to the plan shown at purchase and your statutory consumer rights.
- Cancelling a subscription is different from closing your account or permanently deleting your data.
- Nothing in these Terms removes rights that UK consumer law gives you.
This summary is provided for convenience only. If there is any inconsistency between the summary and the full Terms, the full Terms apply.
